Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Session Surf Tracker (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App. “We,” “our,” and “us” refer to the developers of Session Surf Tracker.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Notify us immediately of any unauthorized use of your account.
• Not share your account credentials with others.
• Not create multiple accounts for the purpose of abusing the service.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Free trial

Session Surf Tracker offers a 7-day free trial for new subscribers. You will not be charged during the trial period.

Subscription pricing

After the trial, subscription plans are:

• Monthly: $4.99 / month
• Annual: $19.99 / year

Prices may vary by country and are displayed in the App Store or Google Play before purchase.

Auto-renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer refunds for unused portions of a subscription period, except as required by applicable law.

Payment processing

All payments are processed by Apple (iOS) or Google (Android) through their respective App Stores. We do not have access to your payment information.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the App or its related systems.
• Reverse-engineer, decompile, or disassemble the App.
• Upload or transmit any content that is harmful, offensive, or infringes on third-party rights.
• Use the App to spam, harass, or harm other users.
• Interfere with or disrupt the integrity or performance of the App or its servers.

6. Intellectual Property

The App, including its design, code, graphics, and content (excluding your personal data), is owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any content you submit to the App (such as session notes). By submitting content, you grant us a limited license to store and display that content for the purpose of providing the service to you.

7. Third-Party Services

The App integrates with third-party services including Surfline (conditions data), Firebase (authentication, notifications), Supabase (data storage), and RevenueCat (subscription management). Your use of these integrations is subject to the respective third parties' terms of service and privacy policies. We are not responsible for the availability or accuracy of third-party data.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Surf conditions data (including wave forecasts from Surfline) is provided for informational purposes only. Always assess actual ocean conditions yourself before entering the water. Surfing involves inherent risks; you assume all responsibility for your safety in the ocean.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at the email below.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page and, where appropriate, by in-app notification. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
